We would like to share some of the recent legal successes TMPA has had for our members. In this report, we will give the names of the attorneys who represented our members but omit the names of the members involved.

Paul G. Aman – Paul G. Aman, Attorney at Law, P.C.
• Member was involved in an incident in the jail and was criminally charged and indicted for use of force. After trial, the state dismissed the indictment.
• Member was placed under IA for use of force. Upon review, member was exonerated, and the case was closed.
• Member was placed under IA for unprofessional conduct. Upon review, member was exonerated.
• Member was involved in an on-duty shooting. Upon review, the member was no billed and the case was closed.
• Member was placed under IA for violating policy during an arrest. Upon review, member received verbal counseling and was exonerated from any wrongdoing.
• Member was placed under IA for running a license plate off duty. Upon review, member was no billed but received a 48-hour suspension.
• Member was involved in an on-duty shooting. Upon review, member was no billed.
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.
• Member was placed under IA for not assisting a subordinate with a use of force incident. Upon review, the charges were not sustained, and the case was closed.
• Member was placed under IA for abuse of sick leave. Upon review, the complaint was investigated and dismissed.
• Member was placed under IA for leaving an assignment early. Upon review, the member was exonerated.
• Member was placed under IA for official oppression. Upon review, member was exonerated, and the case was closed.

Kenneth Biggs – Biggs & Greenslade, PC
• Member was placed under IA for use of force and required fit for duty review. After completing the evaluation, member was deemed fit for duty and placed back on patrol.
• Member was placed under IA for citizen complaint. Upon review, the department did not sustain the allegations, and the investigation was closed without reprimand.

Greg Cagle - Gregory Cagle, Attorney at Law, P.C.
• Member received a 10-day suspension for causing a riot in the jail. After appeal, the suspension was reduced to 5 days.
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.

Steven Dunbar – Law Offices of Steven M. Dunbar
• Member was placed under IA and put on administrative leave for being arrested for a child custody warrant. After pre-trial hearing, the charges were dropped, and the investigation was closed without discipline.
• Member was placed under IA and indefinitely suspended for abuse of police powers and insubordination. After arbitration, member was reinstated with no loss of time and the suspension was reduced to a written warning.
• Member was accused of civil rights violations and sued. After extensive pre-trial, the case against the officer was dismissed.
• Member was placed under IA for body worn camera violations. Upon review, the charges were dismissed.
• Member was the focus of administrative restrictions and denied a transfer. Upon review, the denial was rescinded, and member was allowed to transfer to a specialty unit.
• Member was demoted without cause by incoming sheriff in violation of civil service rules. After a grievance was filed, the member was reinstated to previous rank.
• Member was demoted without cause or permission from the Commissioner’s Court. After a grievance was filed but before a hearing could be held, the member was reinstated to previous rank.

William Lee Hon – Hon Law Firm PLLC
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.

Zach Horn – Gorsky, Gilbert, Snider, Horn, Rogers, Watsky, LLP
• Member was involved in an on-duty shooting. Upon review, member was no billed.
• Member was involved in an on-duty shooting. Upon review, member was no billed and the case was closed.

Chad Hyde – Law Office of Chad R Hyde, PLLC
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.

Robert McCabe – Law Office of Robert M. McCabe
• Member was placed under IA for assault family violence. Upon review, the case was closed as not sustained.
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member and the case was closed.
• Member was placed under IA and indefinitely suspended for body camera violation and official oppression. After appeal, member was reinstated to the department with backpay awarded, and the official oppression charge was rejected by the DA.

Randall Moore – Law Offices of Randall D. Moore, PLLC
• Member was placed under IA for use of force. Upon review, member was exonerated.
• Member received a general discharge on F5. After appeal, an Administrative Law Judge ordered the F5 be amended to reflect an honorable discharge.
• Member was placed under IA and received a 5-day suspension for dereliction of duty and tardiness. After appeal, the 5-day suspension was reduced to 1-day and the case was closed.
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.
• Member was placed under IA for official oppression and assault on coworker. Upon review, the DA did not file charges and the case was closed.
• Member received a general discharge on F5. After appeal, F5 was amended to reflect an honorable discharge.
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.
• Member was placed under IA for racial profiling. Upon review, member was exonerated, and the case was closed.
• Member received a general discharge on F5. After appeal, F5 was amended to reflect an honorable discharge.
• Member was involved in a pursuit with injuries. Upon review, member was cleared by IA and the case was closed.
• Member was placed under IA and terminated for repeated tardiness and absences. After appeal, the termination was reduced to 30-day suspension and member was reinstated with some backpay.
• Member was involved in an on-duty shooting. Upon review, member was no billed.
• Member was involved in an on-duty shooting. Upon review, the grand jury no billed member.

Eric Perkins – Perkins & Perkins
• Member was involved in an on-duty shooting. Upon review, the DA rejected the case and member returned to active duty.

Bailey Sapien – Bailey Sapien, Attorney at Law
• Member was involved in an on-duty shooting. Upon review, the member was no billed.
• Member was involved in a pursuit that ended in a shooting. Upon review, the member was no billed.

John Snider – Gorsky, Gilbert, Snider, Horn, Rogers & Watsky, LLP
• Member was involved in a pursuit that ended in a shooting. Upon review, a hearing examiner found the excessive force charges not true.
• Member was placed on administrative leave for excessive force. Upon review, member was no billed.

Ray Thomas – Raymond L Thomas, Attorney at Law
• Member was placed under IA for sexual harassment. Upon review, no formal IA was started, and member was cleared as unfounded.

John Wolf – Wolf & Stallings, PLLC
• Member was given two written reprimands: one for inappropriate social media content, and one for an argument with a coworker. Upon review, the discipline was removed, and the case was closed.
• Member was placed under IA with possible criminal charges for domestic violence. Upon review, the criminal case was dropped, and member was reinstated.
