TMPA Wins!

January – 2020

 

We would like to share some of the recent legal successes TMPA has had for our members.  In this report, we will give the names of the attorneys who represented our members but omit the names of the members involved.

 

Paul G. Aman

  • Member was placed on administrative leave for use of force. After review, member was exonerated and returned to full duty.

  • Member was placed under IA for use of force but after review, was exonerated.

  • Member was given a 1-day suspension for body camera violation. Upon appeal, the suspension was reduced to a written reprimand.

  • Member was placed under IA for racial profiling. Upon review, complaint was unfounded, and case was closed. 

 

Kenneth Biggs

  • Member received reprimand for use of force. After appeal, the disciplinary documentation was removed from member’s file and case was closed.

     

Greg Cagle

 

  • Member was involved in a shooting. After being presented to the Grand Jury, the member was no billed and case was closed.

  • Member was involved in a shooting. After being presented to the Grand Jury, the member was no billed and case was closed.

  • Member given a Dishonorable Discharge on F-5. Upon appeal, a SOAH judge ordered the member’s F-5 be amended to reflect an Honorable Discharge.

 

Douglas Freitag

 

  • Member was terminated and given a Dishonorable Discharge. Upon appeal, a SOAH judge ordered the member’s F-5 be amended to reflect an Honorable Discharge.

  • Member was given a General Discharge on F-5. Upon appeal, the Administrative Law Judge ordered the member’s F-5 be amended to Honorable Discharge.

 

Roberto Garcia

  • Member placed under IA for hostile work environment. After review, the complaint was unsubstantiated, and the case was closed.

  • Member was terminated for use of force and given a Dishonorable Discharge on F-5. Upon appeal, the Administrative Law Judge ordered the member’s F-5 be amended to reflect a General Discharge.

 

Robert Rogers

  • Members were involved in a shooting. After being presented to the Grand Jury, the members were no billed and case was closed.

 

David Willis

  • Member was placed on administrative leave for failing a drug test. After review of the collective bargaining agreement, a hearing examiner sustained the grievance, member’s record and personnel file were cleared and member was made whole for any wages lost.
