We would like to share some of the recent legal successes TMPA has had for our members. In this report, we will give the names of the attorneys who represented our members but omit the names of the members involved.
Paul G. Aman – Paul G. Aman,
Attorney at Law, P.C.
• Member received a
general discharge on F5. After appeal, the administrative law judge ordered the
F5 be amended to reflect an honorable discharge.
• Member was
involved in an on-duty shooting. Upon review, member was no billed.
• Member was served
with multiple complaints from a subordinate and was relieved of duty with pay.
Upon review, member was exonerated, and returned to full duty status.
• Member was placed
under IA for neglect of duty. Upon review, the charges were unfounded, and IA
was closed.
• Member was placed
under IA for mishandling a call. Upon review, member was exonerated, and IA was
closed.
• Member received a
general discharge on F5. After appeal, the administrative law judge ordered the
F5 be amended to reflect an honorable discharge.
• Member was placed
under IA for injury to a child during a criminal investigation. Upon review,
the charges were unfounded.
Kenneth Biggs – Biggs &
Greenslade, P.C.
• Member was
involved in an in-custody death. Upon review, no action was taken against
member and the case was closed.
Greg Cagle – Gregory Cagle,
Attorney at Law, P.C.
• Member was
involved in an on-duty shooting. Upon review, member was no billed.
Steve Dunbar – Law Offices
of Steven M Dunbar
• Member was placed
under IA and received a written reprimand for failing to write a report. Upon
review, the reprimand was changed to counseling.
• Member was placed
under IA, transferred, and lost side jobs for six months for falling asleep
while guarding a prisoner. After appeal, member got side jobs back with no
effect on future promotions/transfers and will return to original position.
Robert M McCabe –
Law Office of Robert M McCabe
• Member was
involved in an on-duty shooting. Upon review, the grand jury cleared member of
any wrongdoing.
Randall Moore – Law Offices
of Randall D. Moore, PLLC
• Member was placed
on administrative leave for use of force. After appeal, the IA was closed with
no findings, member resigned with honorable discharge, and received 30-days’
pay/insurance.
• Member was placed
under IA for violating the department’s privacy policy. Upon review, the IA was
concluded with all charges unfounded.
• Member was placed
under IA and received a 2-day suspension for failed drug screen. After appeal,
the suspension was reduced to a written reprimand.
• Member was placed
under 2 IAs for intimidating a council member and for violating a
non-disclosure agreement. Upon review, the IA was concluded with all charges
unfounded.
• Member was placed
under multiple IAs for harassment and discrimination. Upon review, the
allegations were unfounded, and the case was closed.
• Member was
involved in an on-duty shooting. Upon review, member was cleared of any
violations of the use of force policy.
• Member was
involved in an on-duty shooting. Upon review, member was no billed by the grand
jury.
• Member was placed
under IA for filing complaints on city council members. Upon review, all
charges were unfounded, and the case was closed.
Adam Muery – Muery &
Farrell, P.C.
• Member filed
Affirmative Civil Action suit for sexual discrimination based on retaliatory
discharge from employment for complaining about sexual harassment. After
negotiations, a settlement was reached, and member received a positive
reference letter and paid accrued time off.
Robert Rogers – Lyon,
Gorsky, Gilbert, LLP
• Member received a
dishonorable discharge on F5. After appeal, the administrative law judge
ordered the F5 be amended to reflect an honorable discharge.
Andrew Stinson – Ramey &
Flock, P.C.
• Members were
involved in an on-duty shooting. Upon review, members were no billed by the DA,
and the case was closed.
• Member was
involved in an on-duty shooting. Upon review, member was no billed.
