If you are injured at work:
If you are injured at work, you must report the injury to your employer. The best practice is to report the injury immediately and in writing. If you wait too long to report the injury, there is a chance your claim can be denied for failing to report the injury.
If your employer refuses to submit the claim to the insurance carrier, or adjuster, you have the right to file the report with the Texas Department of Insurance (TDI) yourself. You can access this form here.
If any part of your claim is denied, you should contact the Texas Department of Insurance- Workers Compensation (TDI-WC) Division and ask to speak with an ombudsman. This ombudsman does not work for the insurance company and is there to assist you while you navigate through the workers compensation program.
The TDI-WC website will provide you with additional information on the rules and regulations pertaining to injured employees.
